1. Acceptance of Terms
By downloading, installing, or using TheQuickFox ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.
2. Description of Service
TheQuickFox is an AI-powered desktop assistant for macOS that provides writing assistance, feedback, and coding help across various applications.
3. License
We grant you a limited, non-exclusive, non-transferable license to use TheQuickFox for personal or commercial use, subject to these terms.
4. Updates and Availability
We may from time to time provide enhancements or improvements to the features/functionality of the Software, which may include patches, bug fixes, updates, upgrades, and other modifications ("Updates"). Updates may modify or delete certain features and functionalities of the Software. You agree that we have no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the Software to you.
5. Content Ownership and License
Your use of the Software is also governed by our Privacy Policy. Ownership: You retain all ownership rights to the content you input or generate using the Software.
License to Company: By using the Software, you grant Foxwise AI FZ-LLC a worldwide, non-exclusive, royalty-free license to use your content solely for the purpose of providing, maintaining, and improving the Software and developing new products or services.
6. User Responsibilities
You agree to:
- Use the Software in compliance with all applicable laws.
- No Competitive Use: You may not access or use the Software to build a product or service that competes with Foxwise AI FZ-LLC or any of its current or future products.
- No Model Training: You may not use the Software or its Output to develop, train, or fine-tune any artificial intelligence or machine learning models.
- No Reverse Engineering: You may not decompile, reverse engineer, disassemble, or attempt to derive the source code or underlying models of the Software.
- Fair Usage: You agree not to use the Software in a manner that exceeds reasonable request limits, constitutes excessive consumption of resources, or disrupts the Service for other users.
- Not use the Software for illegal or harmful purposes.
- Maintain the security of your account credentials.
7. AI-Generated Content
Content generated by TheQuickFox is provided for assistance purposes only. While you retain ownership of the output, you acknowledge that AI systems may occasionally produce incorrect or misleading information ("hallucinations"). You are solely responsible for reviewing, verifying, and vetting all AI-generated content before use.
8. Subscriptions and Billing
The Software is offered on a subscription basis. By selecting a paid subscription, you agree to pay the fees indicated at the time of purchase. Subscription fees are billed in advance and are non-refundable except as required by law. We reserve the right to modify our pricing with reasonable notice.
9. Termination
We reserve the right to suspend or terminate your access to the Software at any time for violation of these terms or for any other reason.
10. Disclaimer and Limitation of Liability
The Software is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted by law, Foxwise AI FZ-LLC expressly disclaims all warranties, whether express, implied, statutory, or otherwise.
In no event shall Foxwise AI FZ-LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software.
11. Dispute Resolution and Arbitration
Please read this section carefully—it affects your legal rights.
Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Software shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement.
Arbitration Agreement:
- Arbitration will be conducted by a single arbitrator in Dubai, UAE
- Arbitration shall be governed by the Dubai International Arbitration Centre (DIAC) rules
- The arbitration will be conducted in English
- Each party shall bear its own costs of arbitration
- The arbitrator's decision shall be final and binding
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
12. Governing Law
These terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles.
13. Changes to Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of TheQuickFox after the updated Terms take effect constitutes your acceptance of those changes.
